Terms of Service

By accessing or using Coba's services, website, or APIs, you agree to be bound by these Terms of Service. If you are using our services on behalf of a business, you represent that you have the authority to bind that entity. If you do not agree, you may not use our services.

2. Description of Services

Coba provides cross-border payment infrastructure, including instant payments, multi-currency banking, global payouts, and embedded financial APIs for businesses operating in the Americas. Our services are designed for business use and may be subject to regulatory requirements in each jurisdiction.

3. Account Terms

You must provide accurate and complete information during registration and keep your account details current. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify Coba immediately of any unauthorized use.

4. Prohibited Uses

You may not use Coba's services for illegal activities, money laundering, terrorist financing, fraud, or any purpose that violates applicable laws. We reserve the right to suspend or terminate accounts that engage in prohibited activity without prior notice.

5. Fees and Payments

Fees are outlined on our pricing page and in your service agreement. We may update fees with 30 days' prior notice. You are responsible for all applicable taxes. Disputed charges must be reported within 60 days of the transaction date.

6. Limitation of Liability

To the maximum extent permitted by law, Coba shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability is limited to the fees paid by you in the twelve months preceding the claim.

7. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Privacy Policy

1. Information We Collect

We collect information you provide directly, including business details, personal identification, and financial data required for KYC/AML compliance. We also automatically collect device information, IP addresses, browser type, and usage patterns through log files and analytics.

2. How We Use Your Information

We use your data to provide and improve our services, process transactions, verify identity, comply with legal obligations, prevent fraud, and communicate account updates. We may also use aggregated, anonymized data for analytics and product development.

3. Information Sharing

We do not sell your personal information. We share data with banking partners, payment processors, and regulatory bodies as required to deliver our services and comply with applicable laws. Third-party providers operate under strict confidentiality agreements.

4. Data Security

We implement industry-standard security measures including encryption at rest and in transit, multi-factor authentication, SOC 2 Type II compliant infrastructure, and regular security audits. No method of transmission is 100% secure, but we strive to protect your data.

5. Data Retention

We retain personal data for as long as your account is active and as required by financial regulations, typically a minimum of five years after account closure. Transaction records may be retained longer for anti-money laundering compliance.

6. Your Rights
